Hello,

My name is Bryan Reo and I recently made a DMCA complaint about Nimbusters stealing pictures from my blog and posting pictures of myself (pictures where I am the person pictured and the photographer and thus the only person with an exclusive claim). At the present time they have removed the picture they stole from my blog... However, in an attempt to exploit a common TOS loop-hole they are uploading my copyrighted pictures to image hosting sites and then posting links on their forum, figuring that they are not directly violating my copyrights...

However, a US District Court recently ruled that posting a link to material that is a copyright infringement is itself a copyright violation. They ruled on a case involving a site that was hosting copyrighted images elsewhere and then linking to them on their main site, in an attempt to protect their main site from copyright complaints. Summary judgement was granted for the plaintiff.

These people are repeatedly violating my copyrights by posting links to image hosting sites where unauthorized reproductions of my images appear, since posting a link to a copyright infringement is itself a copyright infringement. They are using image hosting sites in attempt to exploit what in their understanding is a loophole in US copyright law, although this loophole has been closed in court rulings across the nation...

Thus under penalty of perjury, I, Bryan Reo, do hereby declare that I have a good-faith belief to believe that my copyrights are being infringed and violated, repeatedly, at the links above, on the above mentioned website, www.nimbusters.org and it is my wish at this time to make an official complaint under the DMCA.

The above infringements are just what I could find in ten minutes of searching the first few pages of their forum. The actual number of violations likely numbers in the hundreds if not thousands.
