Decorated Combat Veteran Arrested In New York: Charged With 5 Felonies For Possession of AR Magazines
In the latest attack on the American people, a decorated War Hero has been arrested and charged with five counts of third degree criminal possession of a weapon, for having empty 30 round AR-15 Magazines in his vehicle.
On Sunday January 6th Staff Sgt. Nathan Haddad, a decorated combat veteran, was driving through Jefferson County New York when he was randomly pulled over for a vehicle check. Haddad, who had five 30 round empty magazines in his possession, was arrested by the Jefferson County Sheriff’s Department and charged with five felony counts.
According to Haddad’s brother, Michael Haddad, Nathan thought these magazines were legally made before the New York Assault Weapons Ban. When Nathan Haddad was arrested the new ban had not even been fully enacted yet.
This is not a criminal, this is not some thug looking to hurt people; this is a decorated combat veteran who was recently honored by the Philadelphia chapter of Blue Star Mothers and the Union League’s Armed Services Council for helping disabled vets get back on their feet. What’s happening to Army veteran Nate Haddad is an absolute attack on liberty. Here we have a man who honorably served his country, who was trusted with weaponry that far exceeded anything he was carrying, that now finds himself facing the possibility of spending years in prison.

The Jefferson County Sheriff’s Office has 26 Deputy
Sheriffs and 5 sergeants assigned to law enforcement duties, 6
detectives assigned to the serious crimes unit and 3 detectives assigned
to the Metro-Jeff Drug Task Force. The law enforcement division of the
Sheriff’s Office is overseen by the law enforcement lieutenant.
The deputy sheriffs act as the agency's first responders to all crimes and accident scenes and investigate misdemeanor crimes as well as some felonies. They also present a deterrent to criminal activity; maintain safe highways through aggressive vehicle and traffic law enforcement and strict enforcement of all DWI laws. The deputies also serve and enforce various court related documents such as subpoenas, orders of protection, removal orders and any other orders issued by the courts.
The detective unit investigates all serious felony offenses as well as sensitive misdemeanor cases. This unit handles a wide variety of serious offenses ranging from child/sexual abuse, rape, kidnapping, robbery, arson, homicides and fatal accidents including automobile and industrial accidents.
The members of the Metro-Jeff Drug Task Force work in conjunction with the City of Watertown Police Department and the Jefferson County District Attorney’s Office. The drug task force is responsible for investigating all drug-related offenses and routinely assists with other major crime investigations since many are connected to drug trafficking.
The recreation patrol unit consists of 6 assigned members who patrol, monitor, and enforce the laws associated with recreational-use vehicles and routinely participate in numerous drills, exercises and search and rescue missions. The unit patrols the waterways of Lake Ontario and The St. Lawrence River during the summer months. During the fall and spring seasons, the patrol will often patrol rural camp areas and trails by ATV. The patrol moves to snowmobiles during the winter season and often patrols the numerous trails that run through Jefferson County and concentrate on safety issues including speed and Snowmobiling While Intoxicated. The recreation patrol also serves as a frontline unit for patrolling the northern border for drug trafficking as well as human trafficking and intelligence gathering.
The Canine (K9) unit consists of three deputies and their K9 partners. Two of the K9’s are trained in patrol tactics as well as narcotics detection while the third K9 is trained in patrol tactics and bomb detection. The K9 unit is very effective in the detection of narcotics and has been instrumental in numerous narcotic investigations and the seizures of large amounts of drug-related currency. This unit is often called upon by neighboring agencies to assist with drug- and bomb-related investigations.

Dawn Laughlin Cabrera I think NYS will now lose even more taxpaying residents to firearm friendly/low to no state tax states. I left in September. I didn't even bother attempting to get a pistol permit in NYS since it's a hoop jumping, very costly process. I came to Florida in September and already have my concealed carry permit. I took some gun safety courses and now feel very comfortable with firearms. NYS seems more communist than ever. I always thought NYS seemed like it's own little country. I feel so much freer and safer down here in Florida than I ever felt in NYS. I moved back up to NYS after the other Cuomo left office and will sure not live through another one. This one is on a massive power trip and is nuttier than a fruit cake.-
Jefferson County Sheriff's Office There has been a lot of interest in a recent JCSO arrest for criminal possession of a weapon in the third degree, which, contrary to what some are assuming, was unrelated to the NYSAFE Act, made before the NYSAFE Act existed, and before any details of the NYSAFE Act were known to the public or the law enforcement community.
Keep in mind an investigating agency has the advantage of knowing all of the facets of an incident, rather than just what you may have seen in the media. And as with any arrest, a defendant is given some privacy as well, which is why the public gets limited information.
As you have seen and read, the NYSAFE Act dropped magazine capacity from ten rounds to seven, meaning the existing law {PL §265.02 sub 8} already limited magazine capacity to ten rounds. PL §265.02(8) has been on the books, unchanged, in excess of 12 years:
§ 265.02 Criminal possession of a weapon in the third degree.
A person is guilty of criminal possession of a weapon in the third degree when:
(8) Such person possesses a large capacity ammunition feeding device. Criminal possession of a weapon in the third degree is a class D felony.
Definition:
23. "Large capacity ammunition feeding device" means a magazine, belt, drum, feed strip, or similar device, manufactured after September thirteenth, nineteen hundred ninety-four, that has a capacity of, or that can be readily restored or converted to accept, more than ten rounds of ammunition; provided, however, that such term does not include an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.
